Rentman understands that visitors to our website, potential customers and users of Rentman’s services care about how their information is collected, used, processed, transferred, stored and shared. This Privacy Policy describes Rentman’s commitment to protecting your privacy. It forms part of our Terms and Conditions (“Terms & Conditions”). Any capitalized terms not defined in this Privacy Policy are defined as set out in the Terms.

This Privacy Policy describes how Rentman handles data as a data controller, meaning all data we process for our own purposes. Where Rentman is a processor of data, that activity is generally governed by our Data Processing Agreement, part of the Terms. By using our Websites or Services, you consent to the data practices described in this Privacy Policy. We periodically update this Privacy Policy. If you have an account you will receive notice when this Privacy Policy is modified.

 

1. Applicability

This Privacy Policy describes how Rentman handles data as a data controller, meaning all data we process for our own purposes. Where Rentman is a processor of any information, files, notes, messages or other content submitted through Services accounts (“Customer Data”), that activity is generally governed by our Data Processing Agreement, part of the Terms & Conditions.

 

2. Information Rentman Collects And Receives

To the extent Information is associated with an identified or identifiable natural person and is protected as personal data under applicable data protection law, it is referred to in this Privacy Policy as “Personal Data.” Rentman may collect and receive Customer Data and other information and data in a variety of ways:

2.1. Customer Data. Customers, Power Users, Crew Members or other individuals granted access to a User Account (“Authorized Users”) purposely submit Customer Data to Rentman when using the Services. Data protection law differentiates between the “controller” and “processor” of Information. Customer is the controller of Customer Data and Rentman is the processor of Customer Data and the controller of Other Information. Customer shall have sole responsibility for the use and accuracy, quality, and legality of Customer Data and the means by which Customer acquired Customer Data. Customer and Rentman have agreed upon the processing of Customer Data by Rentman in the DPA.

2.2. Other Information. Rentman also collects, generates and/or receives data other than Customer Data (“Other Information”).

2.2.1. When you visit the Website, you are not required to actively provide any information, but we may collect some of your Personal Data.

2.2.2. When you create or update a User Account: you supply Rentman with: an email address, company name, user name, your name and phone number and/or similar account details. In addition, if you purchase a paid version of the Services, you provide Rentman (or our payment processors) with billing details such as credit card information, banking information and/or a billing address. No one is under an obligation to provide any Customer Data or Other Information (collectively, “Information”). However, certain Information is collected automatically and, if some Information, such as User Account setup details, is not provided, we may be unable to provide the Services.

2.2.3. When you apply for a job at Rentman: you supply Rentman with at least: your email address, name, phone number and resume.

2.3. Rentman collects the following categories of Other Information:

Services Metadata. When a Customer or an Authorized User interacts with the Services, metadata is generated that provides additional context about the way Customers and Authorized Users work. For example, Rentman logs: the number of requests and the functionalities used.

Log data. Our servers automatically collect information when you access or use our Website or Services and record it in log files. This log data may include the Internet Protocol (IP) address, the address of the web page visited before using the Website or Services, browser type and settings, the date and time the Services were used, information about browser configuration and plugins, language preferences and cookie data.

Device information. Rentman collects information about devices accessing the Services, including type of device, what operating system is used, device settings, application IDs, unique device identifiers and crash data.

Cookie Information. Rentman uses cookies and similar technologies in our Website and Services that help us collect Other Information. The Website may also include cookies and similar tracking technologies of third parties, which may collect Other Information about you via the Website and across other websites and online services.

Third Party Services. Youcan choose to permit or restrict Third Party Services for their User Accounts. Typically, Third Party Services are software (like Quickbooks or Exact) with which our Services integrate, and Customers can enable and disable these integrations. Once enabled, we may share certain information with the provider of a Third Party Service and the Third Party Service may share certain information with Rentman. For example, if a Exact is enabled to permit Information to be imported or exported to a User Account, we may (temporarily) receive a user name and an email address, along with additional information that the Third Party Service has elected to make available to Rentman (or vise versa) to facilitate integration.

Third Party Data. Rentman may receive data about organizations, industries, Website visitors, marketing campaigns and other matters related to our business from our partners or others that we use to make our own information better or more useful.

Additional Information. We receive Other Information when submitted to our Website or if you request support, interact with our social media accounts or otherwise communicate with Rentman.

 

How Rentman Uses Other Information

2.4. Rentman uses Other Information to boost our interests in operating our Services, Website and business. More specifically, Rentman uses Other Information:

    • To provide, improve, maintain and modify our Services, Website and business.
    • As required by applicable law, legal process or regulation.
    • To respond to your requests, comments and questions.
    • To develop new products/features.
    • To send emails and other communications.We may send you service, technical and other administrative emails, messages and other types of communications. We may also contact you to inform you about updates in our Services, our Services offerings, and important Services-related notices. These communications are considered part of the Services and you may not opt out of them. In addition, we sometimes send emails about new product features, promotional communications or other news about Rentman. These are marketing messages and you can control whether you receive them.
    • Forbilling, account management and other administrative matters.
    • To investigate and help prevent security issues and abuse.
    • For recruitment purposes, in case you apply for a job with us.


      If Information is aggregated or de-identified so it is no longer reasonably associated with an identified or identifiable natural person, Rentman may use it for any business purpose.

 

3. Data Retention Other Information

Customer Data is retained and deleted as described in the DPA. The deletion of Customer Data and other use of the Services by Customer may result in the deletion and/or de-identification of certain associated Other Information. Rentman may retain Other Information pertaining to you for as long as necessary for the purposes described in this Privacy Policy. This may include keeping your Other Information after you have deactivated your account for the period of time needed for Rentman to pursue legitimate business interests, conduct audits, comply with (and demonstrate compliance with) legal obligations, resolve disputes and enforce our agreements.

5. How Rentman Discloses Information

5.1. Customer’s Instructions. Rentman will solely share and disclose Customer Data in accordance with Customer’s instructions, including any applicable terms in the Terms of Service and Customer’s use of Services functionality, and in compliance with applicable law. The Customer exclusively controls the Customer Data and gets to decide what to do with Customer Data.

5.2. Rent from a friend. The Services provide different ways for Customers to work together or rent equipment or crew members from other User Accounts for which purpose Information, such as an Authorized User’s profile Information or planning may be shared.

5.3. Customer Access. Authorized Users and other Customer representatives and personnel may be able to access or modify access to Other Information. This may include, for example, your employer using Service features to export logs of User Account activity, or accessing or modifying your profile details.

5.4. Third Party Service Providers and Partners. We may engage third party companies or individuals as service providers or business partners to process Other Information. These third parties may, for example, provide storage services, payment processing, data analytics, business development and customer service. To ensure that your Personal Data is collected, processed, used, stored, and transferred securely and in accordance with applicable law, Rentman uses third parties that provide sufficient guarantees to implement appropriate technical and organizational measures to protect your information. For such third parties that may transfer Personal Data outside the European Economic Area, Rentman confirms that it implements appropriate safeguards for such transfers (e.g. EU Standard Contractual Clauses, and binding corporate rules).

5.5. During a Change to Rentman’s Business. If Rentman engages in a merger, acquisition, bankruptcy, dissolution, reorganization, sale of some or all of Rentman’s assets or stock, financing, acquisition of all or a portion of our business, a similar transaction or proceeding, or steps in contemplation of such activities (e.g. due diligence), some or all Other Information may be shared or transferred, subject to standard confidentiality arrangements.

5.6. Aggregated or De-identified Data. We may disclose or use aggregated or de-identified Other Information for any purpose. For example, we may share aggregated or de-identified Other Information with prospects or partners for business or research purposes, such as telling a prospective Rentman customer the average amount of time spent within a typical User Account.

5.7. To Comply with Laws. If we receive a request for information, we may disclose Other Information if we reasonably believe disclosure is in accordance with or required by any applicable law, regulation or legal process. Rentman will only disclose Customer Data if required by a a valid and binding compulsory legal process or if legally required in a police investigation or based on a warrant issued by a court of competent jurisdiction.

5.8. To enforce our rights, prevent fraud, and for safety. To protect and defend the rights, property or safety of Rentman or third parties, including enforcing contracts or policies, or in connection with investigating and preventing fraud or security issues.

5.9. With Consent. Rentman may share Other Information with third parties when we have your consent to do so.

 

6. Security

Rentman takes security of data very seriously. Rentman works hard to protect Other Information you provide from loss, misuse, and unauthorized access or disclosure, see https://rentman.io/nl/data-security. Given the nature of cloud technology, Rentman cannot guarantee that Information, during transmission through the Internet or while stored on our systems or otherwise in our care, will be absolutely safe from intrusion by others.

 

7. If this Privacy Policy Changes

Rentman may change this Privacy Policy from time to time. Laws, regulations and industry standards evolve, which may make those changes necessary, or we may make changes to our business. We will post the changes to this page and encourage you to review our Privacy Policy to stay informed. If we make changes that materially alter your privacy rights, Rentman will provide additional notice, such as via email or through the Services. If you disagree with the changes to this Privacy Policy, you should deactivate your Services account. If you work for one of Rentman’s Customers, the best course is to contact the Customer to request the removal of Personal Data under their control.

 

8. Transfer of Personal Data

Rentman may transfer your Personal Data to countries in and outside the EU, including to and from the United States. To comply with applicable laws, we maintain strong data protection and privacy controls to protect your Personal Data during cross-border and international transfers, as well as during periods of storage in foreign countries (e.g. EU Standard Contractual Clauses).

10. Your Rights

10.1. You have the right to request access to Information, as well as to seek to update, delete or correct this Information. You can send your request to [email protected]. If requested to remove data we will respond within a reasonable timeframe. For the avoidance of doubt, we are not responsible for our Customers' use of Information (User Information) they collect on the Services.

10.2. To the extent that Rentman’s processing of your Personal Data is subject to the General Data Protection Regulation, Rentman relies on its legitimate interests, described above, to process your data. With your explicit consent Rentman may also process Other Information that constitutes your Personal Data for direct marketing purposes for which you may unsubscribe from our marketing communications at any time by clicking on the "unsubscribe" link located on the bottom of our e-mails or by sending us email us at [email protected].

 

11. Data Protection Authority

Subject to applicable law, you also have the right to (i) restrict Rentman’s use of Other Information that constitutes your Personal Data and (ii) lodge a complaint with your local data protection authority or the independent public authority which is established by an EU Member State pursuant to article 51 of the GDPR.
